A Salvadoran national who is living in the US illegally was indicted by a grand jury on assault charges Thursday after he allegedly defrauded Immigration and Customs Enforcement (ICE) agents with his car.
A federal judge returned the indictment of Carlos Ivan Mendoza Hernandez on Thursday, charging him with two counts of assault on a public official with a deadly weapon and one count of vandalizing government property, the U.S. Attorney for the Eastern District of California announced Friday.
ICE agents shot Hernandez, a suspected gang member, in April after he allegedly refused to comply with law enforcement orders, according to authorities.
Agents, sent to Patterson, California, to find Hernandez, found him and his car on April 7 and pulled him over.

“During the traffic stop, Mendoza Hernandez identified himself and the agent told Mendoza Hernandez that he was under arrest and ordered him to exit the vehicle. Despite repeated requests, Mendoza Hernandez kept his vehicle running and did not comply with the agent’s requests,” the US Attorney’s Office said.
Hernandez allegedly drove forward and struck the agent with his car, then “accelerated the vehicle and put it in reverse and quickly reversed, colliding violently with the law enforcement vehicle,” state prosecutors said.
After the incident, Hernandez allegedly crashed his car towards two agents. One of them, who was in the direct path of the car, jumped out. Hernandez then drove across the campus and into traffic, federal prosecutors said.

As Hernandez’s car sped forward, it appeared to veer left onto Sperry Avenue and over the curb in the oncoming traffic lane, prosecutors said.

“During this incident, and due to the movement of the vehicle, the agents removed their firearms from the vehicle and struck Mendoza Hernandez multiple times. Police provided medical assistance at the scene and Mendoza Hernandez was taken to the hospital,” said the US Attorney’s Office.
Law enforcement suspects that Hernandez is part of the 18th Street Gang. He was also wanted in connection with the homicide investigation, Fox News Digital previously reported.

Hernandez’s family disputes the gang-related allegations and says he has been cleared of the murder charges, Fox News Digital previously reported.
If convicted of assault, Hernandez faces a maximum statutory penalty of 20 years in prison and a $250,000 fine for each count. If convicted of vandalism, Hernandez faces a maximum sentence of 10 years in prison and a $250,000 fine, prosecutors said.
Fox News Digital reached out to Hernandez’s attorney for comment but did not immediately receive a response.
