Will No-Trade and No-Movement Clauses Matter in the CBA?

Some tight ends have requested to be traded this offseason, but want to control where they go with their no-trade/no-movement clauses. This will be a CBA issue that will be pursued next

Sportsnet 590 THE FAN: Elliotte Friedman last week on the no-trade and no-movement clauses, and how they will be an issue in the next CBA.

Nick Kypreos: “Do you think there are a few GMs who want Stevie Yzerman to hold tight here.”

Freidman: “Yes.”

Kypreos: “Just sending a message to the players of other teams who think they have only one agent left to choose a place for them, whether they have two, four, or six years on their contract?”

Friedman: “So, Nick, I think this is going to happen.

Now, I had one owner tell me that he knows at least one team that’s talking, because basically the way it works is before every CBA negotiation, Bettman meets with each team, and he says, ‘I want to know what’s important to you.’ And he says, ‘I can’t guarantee it’s going to happen, I can’t guarantee it’s going to be a front burner, but I want to know what’s important to you.’

And this owner told me that there was at least one team that went to Bettman and said we need these no-trade clauses addressed. And Bettman, from what this guy told me, Bettman said, ‘This is a peacetime CBA, we want to do it, everybody’s making a lot of money, and we’re not choosing to fight this, this time.’

I don’t see how this won’t be a problem in the future. In fact, Nick, one of the things I was told was, when Connor Hellebuck asked for a trade to the Jets, the Jets went to him and said, ‘Well, you have to stop your trade now.’ And Hellebuyck was like, ‘I’m not doing that,’ and the Jets were like, ‘You can’t have both.’

Now I think, I think Hellebuyck was more flexible than some of these other teams. I understand, for example, like him, if they had an agreement with Nathi (in the Division), and I think they are still talking about it, he could go. I don’t know many other people who say they will go to Buffalo right now, but I’ve been told that Hellebuyck will let them go if they make a deal. I think he was flexible.

But I think this is, you know, one of the things that we’re going to talk about, they, maybe you find that you still have a no-trade clause or a no-movement clause, but I think you’re going to see teams fight back, if players ask to be traded, well, there have to be consequences for that. Do they have to refund the signing bonus? I’ve never seen that happen, but I just throw things out there.

But one of the things I’m wondering about Nick is, and Justin, are we getting a situation where teams are fighting to say, you have a no-trade clause and you’re asking for one, should there be something written about how much flexibility you have to have?

Now, this is all negotiation, and who knows where we go between then and now, but I think it will be a thing.

Now, one thing I’d like to say, guys, I’ve heard people say, well, Steve Staois should have stuck with Keith Tkachuk or Matthew, Brady Tkachuk. I think that’s easier said than done. That was one day before he left. If that had come out, I think it’s easy for some people to say, ‘Oh, you should have held on.’ When you’re in that seat and your market is going bananas, it’s hard to do sometimes.

But Yzerman is a little different, and I don’t mean that in any negative way. I think there are groups hoping that he will take a hard line here. Although I think in the end, Larkin will deal with it.”

Allan Walsh: “This is the biggest problem in the NHL. No one is forcing teams to issue No Move and No Trade Clauses. They are freely negotiated as part of NHL contracts.”
