Virginia Gov. Spanberger limits ICE’s cooperation during the federal retreat

Enforcing immigration is a fundamental organizational power. Under Article I of the Constitution, Congress has the duty to write our federal immigration laws. Under Article II, the President has a duty to enforce it. States cannot interfere, and certainly not prevent. Unfortunately, many Democrat states, especially Virginia, are in danger of colliding with the federal government.

American voters have given President Trump and the Republican-led Congress a broad electoral mandate to reverse the disaster the Biden-Harris border policy has created in all American states by mass-importing 20 million immigrants, including the worst in the world. Activist judges and other Democrat-choice politicians have done everything they can think of to thwart Trump’s constitutional duty to deport these dangerous illegal aliens.

A recent example is Virginia, which passed a series of unconstitutional laws that would accidentally and illegally block ICE. These proposals include criminal penalties, meaning that state law enforcement will attempt to arrest and detain ICE agents simply for doing their job. This attempt is treasonous, treasonous, highly dangerous and unconstitutional. For the sake of the Republic, the Department of Justice must quickly and forcefully put an end to this conspiracy in Virginia.

Fairfax County District Attorney Steve Descano is the Soros Democrat prosecutor in the DC suburbs, an uber-rich Democrat enclave that is an albatross around Virginia’s neck. Abdul Jalloh is an illegal immigrant who invaded our country in 2012. Jalloh settled in Virginia and began harming the good citizens there, making a number of arrests of 30 people. These include rape and four stabbings of Americans. However, due to the willful insensitivity of the Democratic County’s Fairfax County government, Jalloh only had one case. He violated his probation, spent three months in jail, and got out free thanks to a deal between his attorney and Descano’s office. Sanctuaries like Fairfax County don’t call ICE when they arrest or release illegals like Jalloh, who received a final removal order starting in 2020. Fairfax police repeatedly warned Descano’s office via email that Jalloh’s release would endanger the public, but the pleas fell on deaf ears. Earlier this week, Jalloh allegedly stabbed and killed a 41-year-old mother, Stephanie Minter, at a bus stop.

Virginia Gov. Abigail Spanberger ran as a moderate Democrat. But after his inauguration this year, he quickly showed his leftist colors. He issued an order prohibiting cooperation between federal officials and ICE. Several anti-ICE bills await Spanberger’s signature: (1) a ban on ICE arrests in courthouses (where these so-called dangerous criminals visit daily); (2) a ban on ICE arrests within 40 feet of polling places (where illegals violate federal criminal laws by voting); and (3) criminal penalties for ICE agents who wear masks (because they don’t want to be shamed and killed).

If Spanberger signs these unconstitutional state laws, Trump’s Justice Department should immediately sue and seek to enjoin them in court. A federal judge in Virginia is expected to issue an order, following the lead of the US Court of Appeals for the Ninth Circuit, that has completely suspended a California law that prohibits the illegal use of masks by ICE agents.

But law enforcement is not enough. Virginia Democrat officials plan to arrest ICE agents for doing their jobs (conspiracy under 18 USC § 2384) — and especially those who cause arrest (treason under 18 USC § 2383, assault, kidnapping, detention, conspiracy, etc.) — must go to their state prisons. If anyone is killed in the deadly conflict between these new Virginia agencies and ICE, these Virginia Democrat officials must face murder charges.

Former President Biden and his deranged border boss Kamala Harris have allowed millions of illegal immigrants, including some of the world’s most violent and dangerous criminals, to pour across our borders. Trump is doing everything he can to fulfill his broad electoral mandate and repair the damage by arresting and deporting these illegals.

Virginia’s proposed laws not only prevent communications between federal officials and ICE; rather, they criminalize government enforcement actions clearly within the scope of immigration enforcement powers.

States are not required to assist ICE, for example, by providing law enforcement resources to assist in ICE’s apprehension of illegal immigrants. But states cannot necessarily undermine or prevent these organizational efforts. This is especially true of Virginia’s effort to arrest ICE agents on the job, which may justify their use of deadly force.

Virginia’s attempt to subvert and interfere with federal law must fail. We fought the Civil War because the Confederacy, headquartered in Virginia, wanted to abolish federal law regarding slavery. Today’s Virginia Democrats are returning to their organizational roots. Just as the federal government did during the Civil War and after a century when the separatist states continued their efforts to abolish federal law, the federal government must now stand firm against Virginia’s rebellion and sedition. The Supremacy Clause of the Constitution makes it clear that federal law is supreme in areas where the federal government has jurisdiction.

If Virginia gets away with successfully repealing federal immigration law, other states can repeal any other federal law they find objectionable. Let’s hope Abigail Spanberger comes to her senses and refutes this madness. If he does not, the federal government must use all tools at its disposal, including the Sedition Act of 1807 and other federal criminal statutes, to uphold federal law. Virginia state officials must go to federal prison for engaging in treason, treason, and other serious crimes. Anything less would threaten the existence of the Republic.
