Trump makes historic SCOTUS appearance on birthright citizenship case

President Donald Trump appeared at the Supreme Court on Wednesday to listen as justices weighed his order to deny birthright citizenship.

No president has attended oral arguments at the high court before, underscoring the weight Trump has placed on the landmark case, which could end more than 100 years of precedent that has allowed most US-born children to gain automatic citizenship.

Attorney General Pam Bondi accompanied Trump to the Supreme Court Wednesday morning.

“I’ve listened to this argument for a long time, and this is not about Chinese billionaires, or billions from other countries who suddenly have 75 children or 59 children in one case, or 10 children become American citizens. This was about slaves,” Trump told Fox News’ Peter Doocy in the Oval Office on Tuesday about the case.

At issue is the language in the 14th Amendment that says anyone born in the United States and “under its jurisdiction” is automatically a citizen. Trump noted that the provision was a holdover from the Civil War.

“It had to do with the children of slaves,” Trump said. “It didn’t match the protection of millionaires and millionaires who want their children to get American citizenship. It’s the craziest thing I’ve ever seen. It’s been mistreated by law enforcement over the years.”

Trump’s order would change birthright citizenship, allowing children born to non-residents of the United States to automatically acquire US citizenship, except for those born to foreign officials.

Lower courts have similarly rejected Trump’s policy and blocked it with class-action lawsuits.

Trump has argued that as part of his campaign to reduce immigration, he wants to reduce torture 14th Amendmentwhich would include foreign nationals who visit the United States strictly for the purpose of giving birth with no intention of legally residing in the country.

The amendment also encourages immigrants to enter the country illegally to give birth and rewards pregnant women who are already in the country illegally by granting their children citizenship, the administration said.

Trump is expected to watch as John Sauer, his attorney general, charges the judges that they should side with the president. Traditionally, only judges and opposing lawyers speak during oral arguments.

A lawyer for the American Civil Liberties Union will challenge Trump’s order before the high court on Wednesday. In a statement, the executive director of the ACLU said that Trump “can watch the ACLU school according to the meaning of the Constitution” and that the organization “would be happy to stay close to him.”

“Any attempt to undermine the gravity and importance of this case will fail,” said ACLU executive director Anthony Romero. “The Supreme Court is tasked with interpreting and protecting the Constitution even under the watchful eye of the president sitting a few meters away from them.”
