FIRST ON FOX: A key group of activists accuses Democratic states of filing frivolous lawsuits against the Trump administration for no real reason, and calls on Congress to intervene.
America First Legal, a non-profit organization founded by Trump’s adviser, Stephen Miller, is urging House Judiciary Committee Chairman Jim Jordan, R-Ohio, to open an investigation into the “law” being pushed by blue states that it says is part of a larger effort to block President Donald Trump’s policies.
“The America First Legal Foundation (‘AFL’) has identified a national pattern of dismissing the Trump administration’s agenda: Democratic-controlled states have filed lawsuits against the Trump administration, yet in most cases, the states are unable to show support for their alleged injuries,” wrote the group’s legal counsel Will Scolinos.

There are more than 200 active lawsuits challenging various Trump administration policies right now, according to Lawfare Media’s litigation tracker. Many of those have been introduced by states like California, Colorado, Minnesota, and New York.
Solinos said the AFL had launched an investigation into various blue state cases – allegedly finding that many of them were filed without any physical evidence to support the claims they made.
“The AFL’s investigation reveals that these Democratic-controlled states are admitting to allegations of harm for which there is no corroborating evidence to support their claims,” the letter said.
“The biggest problem is not just that the courts are failing to enforce standing requirements, but that federal attorneys are filing complaints for perceived harm that their client agencies cannot prove.”

The letter said it “raises serious questions about whether these lawsuits were filed in good faith or were instead designed to disrupt the official policies of the Trump Administration through legal intervention.”
The four counties that sued the Trump administration over its transgender policies, for example, said they “didn’t have the records” needed to answer the AFL’s questions on the basis of those lawsuits, the letter said.
Five of the 20 states that have joined a lawsuit over the Department of Homeland Security (DHS) getting access to federal Medicaid data to investigate whether illegal immigrants are receiving health benefits have also told the AFL they will not be able to provide the records they requested, the letter said.
“Such conduct not only undermines the integrity of the federal court system but also abuses the judicial process to prevent legitimate policies of the Trump Administration—policies that the American people voted for,” the AFL said.

“Given the Committee’s authority over Title 28 and the Federal Rules of Civil Procedure, we ask that you investigate this pattern of conduct and consider whether legal action is warranted.”
A spokesperson for the House Judiciary Committee told Fox News Digital when reached for comment, “We appreciate the great work from America First Legal. We are reviewing the report and everything is on the table.”
