Trump Mobile’s terms and conditions say the phone may not come out

It’s been almost a year since the announcement of the American-made Trump Mobile T1 smartphone for realists. It’s not out yet, but this week, we got conflicting information about whether or not it will always Get out.

Today, Trump Mobile CEO Pat O’Brien said the phone will finally start shipping this week. However, Trump Mobile’s terms and conditions make it abundantly clear that the mobile startup brand is under no obligation to post anything.

In the past day or so, several news outlets like The Hill and content creators like moistcr1tikal (who paid a deposit and were waiting for the phone to arrive) noticed some strange language on the terms and conditions page on the Trump Mobile website.

The terms clearly state that “Trump Mobile does not guarantee that: The device will be commercially released,” that “production will begin or continue,” or that “delivery will occur within any specified timeframe.”

For the past year, the company has been accepting $100 deposits on the phone, with the promise that paying that price will “lock in your T1 phone’s promotional rates” of $499 for first-timers. However, the terms and conditions page directly contradicts this language.

According to the latest terms and conditions, a $100 deposit only gives you opportunity buying a phone if let it come out. And if it does, the terms also say it shouldn’t cost $499.

“The pre-order deposit only provides a conditional opportunity if Trump Mobile later chooses, in its sole discretion, to offer the Device for sale,” the website reads. “Deposit does not affect prices…Prices and advertising terms are subject to change at any time prior to purchase.”

There is also one last interesting nugget from the terms and conditions page regarding the specs and other features of the phone.

“Device specifications, features, software, hardware components, storage capacity, additional resources, colors, and configurations may change prior to final sale. Images, prototypes, beta demonstrations, and marketing offers are illustrative only and may not reflect final production units,” the website reads.

This should come as no surprise, as the T1 has already changed quite a bit since it was first announced. Trump Mobile famously dropped its “made in America” tag, for example.

This is probably disappointing to read if you’re really looking forward to a T1 phone, but it’s worth noting that there are real signs that it’s there. The website was recently updated with new specs (which can change at any time), and appeared on the FCC list.

In other words, Trump’s phone will come out this week, or nothing, or maybe sometime between those two things. It’s impossible to say.

It’s sad!
